Terms of Service

These Terms of Service ("Terms") are between you and Adios Global LLC, a Wyoming limited liability company doing business as Adios.dev ("Adios," "Adios.dev," "we," "us," or "our"). These Terms govern your access to and use of the Adios.dev website, platform, APIs, CLI tools, software, hosted runtimes, container environments, orchestration components, automated agents, workflows, previews, deployments, and related infrastructure offerings (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree to these Terms, do not use the Services.

1. Eligibility and Authority

You must be legally able to enter into a binding contract to use the Services. If you use the Services on behalf of a company, startup, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" and "your" refer to both you and the entity you represent.

2. Service Availability

The Services may include preview, early-access, or experimental features that are actively being developed and may contain software bugs, unexpected interruptions, configuration resets, routing changes, data loss, or other operational issues.

Unless we expressly agree otherwise in writing, the Services are provided on an "AS IS" and "AS AVAILABLE" basis without uptime commitments, performance guarantees, or service level agreements. We may modify, throttle, suspend, reset, or discontinue preview, early-access, or experimental features at any time. You are responsible for evaluating whether the Services are appropriate for your use case and for maintaining independent backups of Customer Content.

3. Accounts, Identity Providers, and Security

To access the platform, you must authenticate through approved authentication methods, which may include email verification, third-party identity providers, or source-code providers. You are responsible for maintaining the confidentiality of your account, team access, API keys, session tokens, credentials, repository permissions, and secrets configuration, and for all activity under your account or team.

You must use reasonable security measures for repositories, secrets, applications, domains, and deployments connected to the Services. You must promptly notify us at support@adios.dev if you discover unauthorized access, credential exposure, configuration leakage, or a security incident affecting your account or workloads.

4. Customer Content and Proprietary Code

"Customer Content" means source code, operational data, prompts, configuration files, environment variables, secrets, logs, build files, deployment artifacts, outputs, and other materials that you submit to or generate through the Services. As between you and Adios.dev, you retain ownership of Customer Content. We do not claim ownership of your source code or private repositories.

You grant Adios.dev a non-exclusive, worldwide, royalty-free, fully paid-up license to host, copy, transmit, process, modify, cache, compile, build, package, containerize, replicate, display, and otherwise use Customer Content solely as needed to provide, secure, operate, route, support, troubleshoot, and improve the Services; to follow your configuration and deployment instructions; and to comply with law.

We treat private Customer Content as confidential. We do not sell Customer Content, and we do not use Customer Content to train third-party foundation models unless you expressly enable or request that functionality. We may disclose Customer Content to service providers and subprocessors under confidentiality obligations as needed to provide, secure, support, or improve the Services, or when required by valid legal process.

5. Your Responsibilities for Deployed Applications

You are solely responsible for the applications, APIs, websites, agents, workflows, data, content, outputs, user interactions, and domain configurations that you deploy, publish, route, or make available through the Services, including through platform domains, *.adios.run subdomains, or custom domains.

Adios.dev does not pre-screen, endorse, or assume responsibility for user-deployed code or content. We may investigate, suspend, isolate, disable, remove, or delete deployments, routes, records, container instances, data, or accounts that we believe may violate these Terms, applicable law, third-party rights, platform security rules, or the integrity of the Services.

6. Acceptable Use

You may not use the Services to violate law, infringe third-party rights, interfere with systems or networks, compromise security, abuse shared resources, or harm Adios.dev, other users, or third parties. Prohibited uses include:

• cryptocurrency mining, distributed ledger validation, token minting, or consensus-node operation without our written approval;
• Tor exit nodes, open proxies, public VPN relays, packet anonymization networks, or unauthorized traffic-forwarding tunnels;
• DDoS attacks, automated network scanners, port probes, fuzzing operations, vulnerability testing against third-party systems, or other offensive security activity without authorization;
• aggressive scraping, crawling, or automated data extraction designed to bypass destination rate limits, robots.txt rules, IP bans, or access controls;
• malware, rootkits, ransomware, botnet command-and-control systems, credential theft, phishing, spam, or malicious payloads;
• attempts to bypass, disable, tamper with, or probe our container security controls, namespace boundaries, kernel settings, host isolation, billing systems, rate limits, or platform safeguards;
• illegal, infringing, defamatory, exploitative, deceptive, or harmful content, or content that violates privacy, publicity, or intellectual property rights; and
• workloads that create disproportionate operational risk, security risk, legal exposure, or degradation of shared platform availability.

7. Copyright, Abuse, and Takedown Requests

We may respond to copyright, trademark, abuse, security, or legal notices by removing or disabling access to allegedly unlawful, infringing, harmful, or abusive material. We may suspend or terminate accounts of repeat infringers or repeat abuse sources in appropriate circumstances.

Copyright or abuse reports should include enough information for us to identify the affected deployment, route, domain, repository, or account, along with contact information for the reporting party. Notices may be sent to support@adios.dev. We may request additional information before taking action where appropriate.

8. Third-Party Services and AI Providers

The Services may interoperate with third-party source providers, identity providers, payment processors, infrastructure vendors, analytics tools, communications tools, model providers, cloud services, and other integrations. Your use of third-party services is governed by their own terms and policies.

We are not responsible for third-party products, services, content, availability, security, errors, model outputs, hallucinations, algorithmic bias, or provider decisions. If you connect or enable a third-party integration, you authorize us to exchange information with that provider as needed to provide the integration and follow your instructions.

9. Billing, Subscriptions, and Usage

Paid features may require subscription fees, usage-based charges, resource charges, taxes, or other amounts shown at checkout, in the product, or in an applicable order form. You authorize Adios.dev and our payment processors to charge your payment method for amounts due under your selected plan, renewal, usage, or purchase.

Unless stated otherwise at checkout or in an order form, subscriptions renew automatically until canceled. You are responsible for canceling or downgrading before renewal if you do not want future charges. Fees are non-refundable except where required by law or expressly stated by us. If payment is overdue, disputed, reversed, or fails, we may suspend, limit, downgrade, delete, or terminate access to paid features, deployments, data, and accounts.

Resource limits may vary by plan and may include CPU, memory, storage, bandwidth, build minutes, deployment counts, database capacity, workflow activity, and other quotas. We may enforce limits automatically and may charge for usage above included amounts where applicable and disclosed.

10. Resource Limits and Automated Containment

To protect shared infrastructure and other users, Adios.dev may use automated resource controls, including CPU limits, memory thresholds, network bandwidth limits, storage limits, disk I/O limits, rate limits, queue limits, cgroups, container isolation, process termination, and traffic shaping.

To the maximum extent permitted by law, Adios.dev is not liable for service interruptions, runtime failures, container crashes, process terminations, data loss, or data corruption caused by your workload exceeding configured limits or by automated containment actions, including kernel-level out-of-memory terminations.

11. Network Routing and Anycast Limitations

The Services may use BGP Anycast, geographic DNS, edge routing, caching, load balancing, transit providers, internet exchanges, and other network systems to route traffic. Routing paths, latency, packet loss, and regional availability may be affected by third-party networks, internet service providers, upstream carriers, peering relationships, public internet conditions, and local outages.

We do not guarantee that end-user traffic will always route to the physically closest edge location or that network performance will be uniform across regions, carriers, devices, or time periods.

12. Emergency Platform Protection

We may immediately suspend, isolate, block, rate-limit, null-route, blackhole, disable, remove, or delete any deployment, route, domain, container, account, token, or workload if we believe it creates security risk, legal risk, abuse risk, operational risk, payment risk, excessive resource usage, or degradation of shared platform performance.

This includes workloads targeted by or participating in denial of service attacks, anomalous traffic, outbound abuse, malware, credential attacks, spam, scraping, probing, or behavior that may impair adjacent users, shared hosts, shared network cards, upstream providers, or the Services.

13. Compliance and Restricted Uses

You are responsible for ensuring that your use of the Services complies with applicable laws, regulations, sanctions, export controls, privacy obligations, industry rules, contracts, and internal policies. You may not use the Services if you are barred from receiving them under applicable law or sanctions rules.

Unless we expressly agree otherwise in writing, the Services are not designed for regulated workloads requiring specialized compliance guarantees, including HIPAA, PCI DSS, FedRAMP, criminal justice, emergency services, critical infrastructure, life-safety systems, or uses where failure could lead to death, personal injury, or severe environmental or property damage.

14. Service Changes and Termination

We may modify, improve, limit, suspend, discontinue, or replace any part of the Services at any time. You may stop using the Services at any time. We may suspend or terminate your access immediately if we believe your use presents security, legal, operational, abuse, or payment risk, or if you breach these Terms.

Upon termination, your right to use the Services ends. We may delete Customer Content, deployments, logs, artifacts, routes, domains, and account data after termination or account closure, subject to our retention practices, legal obligations, backups, and legitimate business needs. Sections that by their nature should survive termination will survive, including ownership, confidentiality, payment obligations, disclaimers, indemnity, liability limitations, governing law, and dispute terms.

15. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADIOS.DEV DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, RELIABILITY, AVAILABILITY, ACCURACY, TIMELINESS, AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF HARMFUL COMPONENTS, OR THAT CUSTOMER CONTENT, DEPLOYMENTS, DATA, LOGS, ARTIFACTS, OR OUTPUTS WILL NOT BE LOST, CORRUPTED, EXPOSED, OR DELETED.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADIOS.DEV AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, CODE, BUSINESS INTERRUPTION, SECURITY INCIDENT RESPONSE COSTS, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, REGARDLESS OF THE LEGAL THEORY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ADIOS.DEV FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID TO ADIOS.DEV FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

17. Indemnification

You will defend, indemnify, and hold harmless Adios.dev and its affiliates, officers, directors, employees, contractors, service providers, and licensors from and against claims, damages, losses, liabilities, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: Customer Content; your deployed code, applications, websites, APIs, agents, workflows, outputs, or domains; your use or misuse of the Services; your breach of these Terms; your violation of law; or your violation of third-party rights.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, excluding its conflict-of-law rules. Subject to any mandatory rights you may have under applicable law, you and Adios.dev consent to exclusive jurisdiction and venue in the state and federal courts located in Wyoming for disputes arising out of or relating to these Terms or the Services.

19. Changes to These Terms

We may update these Terms from time to time as the Services evolve. Updated Terms become effective when posted, unless a later effective date is stated. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
